A LIBERAL CONSTRUCTION OF THE OUTSTRETCH OF OUR INFORMATION RIGHTS

Abstract
Judiciary under RTI or RTI under Judiciary? A Right to Information of people or a prerogative of the government? The answer to these fundamental questions was eloquently given by the Supreme Court of India when it averred that the public's informational rights cannot be destroyed at the behest of a misinterpretation of the law. Disconcerted over the abstraction that the Supreme Court and its officiating authority of CJI are distinct and separate, the Court ruled the necessary and declared them to be the same while reaffirming that they both should be included within the peripheries of Right to Information. This paper discusses the need-based requirements of including the office of CJI under RTI. First, it covers the issues of transparency requirements of democracy as there is a growing global trend inclining towards a transparent government. Secondly, the paper, in the light of the Supreme Court judgment substantiates the idea that such transparency cannot be unbridled and can be subjected to the requirement of a larger public interest.
